This privacy policy will explain what data we collect online, why we collect it, and the choices we offer to you.


This privacy policy (“Policy”) describes Digital Bandidos Inc.’s (“Company”, “we”, “our” or “us”) data protection practices, covering services under our control, to include the website we maintain (e.g., https://digitalbandidos.com/), the games we provide, and the social media pages we operate, as well as any other website or mobile application (collectively “Services“).

This Policy is made available prior to your use of the Services. By using the Services, you acknowledge that you have had an opportunity to read this Policy and understand that we will process your data in the manners provided in this Policy. This Policy makes up a series of documents that govern the use of our Services, including our Terms & Conditions (“Terms”) and End User License Agreements (“EULAs”). If you do not agree with our Policies or Terms, please do not use our Services.

Your privacy is not a tradeable asset to us. We don’t sell personal data, and we’re not in the business of data monetization or otherwise profiting off your data. However, certain modern operations, like troubleshooting, completing transactions, and improving our games, do require some data from you and the third parties involved. To that extent, you’ll find the data we collect on our users is largely based on industry practices and secured by our highest standards. Additionally, for purposes such as analytics and targeted advertising, we may share aggregated or non-personally identifiable data with third parties. Under the CCPA, this might be considered “sharing” your data. If you are a resident of California, you have the right to opt out of the sale or sharing of your personal data. I. Our Roles

We operate as both a Data Processor and a Data Controller, handling your personal data, device data, and other related data (collectively, “personal data”) based on your interaction with our Services.

A. Data Processor

As a Data Processor, we handle personal data on behalf of third-party platforms (e.g., Community or Distribution Platforms) according to their instructions. In this role, we support our game titles and partnerships by processing data as directed by these third-parties, without deciding on the purposes or means of data use.

B. Data Controller

When acting as a Data Controller, we determine the purposes and means of processing personal data. This role applies to direct interactions with our Services, where we make decisions regarding data collection, usage, security, and storage, in compliance with applicable privacy laws.

Understanding these roles is important for exercising your privacy rights. When we act as a Data Processor, any inquiries or requests related to data processed on behalf of third-parties should be directed to the respective Data Controllers (i.e., the Community or Distribution Platform). When we act as a Data Controller, you can exercise your privacy rights directly with us, including requests for access, correction, or deletion of your personal data.

II. Data Collection

We may collect personal data through the Services about your use and how you use them.

A. Age Requirements

Our Services are intended primarily for adults, and we are committed to protecting the privacy of all users, particularly those who may be under the age of majority. By using our Services, you confirm that you are either an adult of legal age in your country or that you have obtained parental or guardian consent to access and use our Services. Certain features—such as online multiplayer, in-game purchases, and social interactions—may have additional age requirements and may not be available to individuals below the age of majority in their jurisdiction.

We comply with relevant privacy protection regulations, including the Children’s Online Privacy Protection Act (“COPPA”), the General Data Protection Regulation (“GDPR”), and the California Consumer Privacy Act (“CCPA”). We do not knowingly collect personal information from individuals below the minimum age defined by COPPA or similar regulations. If we discover that we have collected such information, we will take immediate steps to delete it. The type of personal data we collect depends on how you use our Services. Over the past 12 months, we have generally collected the following data:

      • Name, username, gamertag, postal and email address, phone number, unique identifiers (e.g., mobile device ID, platform ID, IP address), and account identifiers from linked social media or third-party gaming accounts.
    • Protected Characteristics
      • Age and gender (only when necessary for professional or gameplay interactions).
    • Commercial Data
      • Purchase and usage history, in-game achievements, gameplay preferences, shipping preferences, and survey responses.
    • Billing Data
      • Payment data (credit/debit card information) and billing address. Sensitive payment information, such as credit card details, is handled by third-party payment providers.
    • Internet / Electronic Activity
      • Browsing and gameplay activity relevant to our Services, including interactions within the Services, engagement data (e.g., likes, comments), subscription data, and ad interactions. Includes anti-cheating and anti-fraud activity data, such as flagged or reported behaviors.
    • Device Data
      •  Details on device type, operating system, language settings, and software/hardware specifics, including device and advertising identifiers (e.g., Apple’s IDFA or Google’s AAID for personalized ads). Data may be collected through frameworks such as Apple’s SKAdNetwork (SKAN) when tracking consent is restricted.
    • Audio / Visual Data
      • Account photos, avatars, gameplay recordings, and audio data from chat or other interactive features, including playtesting and moderated events.
    • Social Media & Linked Accounts Data
      • Account identifiers from third-party social media or gaming platforms (e.g., account ID, username) linked to our Services for integrated gameplay or community interaction.
    • Game Performance Data
      • Specific in-game data, such as achievements, session durations, player actions, and gameplay metrics used to enhance and balance the gaming experience.
    • Community Interactiuons and User-Generated Content (UGC)
      • Content created within our Services, such as chat messages, in-game customizations, player-created mods, and interactions within community forums or in-game chat, which may be monitored to ensure a safe environment.
    • Profile Inferences
      • Data and activity-based inferences, such as in-app preferences or survey responses, used to create profiles for personalized content and recommendations.

      • Account credentials (username and password) and contents of communications within chat, messaging, or other in-game features.

      • Geographic data derived from IP address, device settings, or GPS (with user permission) to tailor content and ads. Mobile-specific geolocation can be enabled or disabled in device settings.
    • Parental Control and Access Restriction Data
      • Data on access and content restrictions for users requiring age-appropriate features or parental controls (e.g., voice chat disabled, age-appropriate content filtering).
    • Professional or Employment-Related Data
      • Information submitted through our Careers page, such as resumes, employment history, and, where applicable, background check data.

We collect personal data from various sources to provide and improve our Services. The types and methods of data collection vary depending on your interaction with our Services, such as accessing games via mobile apps, third-party platforms, or direct engagement on our website. A. Data You Provide Directly

You provide data directly when engaging with our Services, including:

    • When you set up an account, we collect details such as your name, email, password, and any optional profile information.
  • Purchases and Transactions
    • If you purchase games, merchandise, or other digital content, we collect data related to transactions, including order history and billing information. Payment card data is processed by third-party payment processors (e.g., Stripe or PayPal).

    • Data on gameplay, including progress, achievements, and statistics, is collected to enhance your experience.

    • When posting on forums, joining Discord, or using interactive features (e.g., comments, messaging), we collect data associated with these activities. Information shared publicly may be visible to other users.

    • For surveys, contests, or in-person/virtual events, we collect relevant registration data, such as your name, contact information, and event preferences.

For promotional activities, user engagement, and interactive events, we may share data:

    • For sweepstakes, contests, and promotions with partners. Participation is voluntary, with information provided at the time of collection.
  • Referral Services
    • Users can refer friends to our Services. We only collect information shared by users and advise referring friends with consent.

We share personal data under specific circumstances to support our Services, comply with legal requirements, and enhance user experience.

VI. Data Storage & Retention

A. International Data Transfers

We store and process your personal data in the United States. If you are located outside the United States, including in the European Economic Area (EEA), please be aware that your personal data may be transferred to and stored in countries that may not offer the same level of privacy protection as your home country. Where required by applicable law, we implement appropriate safeguards, such as Standard Contractual Clauses, to protect your data during international transfers. By using our Services, you consent to the transfer, processing, and storage of your personal data in these countries.

B. Retention of Personal Information

We retain your personal data for as long as necessary to provide our Services, fulfill the purposes for which it was collected, or comply with legal requirements. Retention periods vary depending on the type of data and the purpose for which we collected it, as follows:

  • Inactive Accounts
    • If your account is inactive for a specified period, we may delete or archive your personal data, including login credentials, in accordance with our Retention Policy. You may be required to create a new account to reengage with our Services.

    • If you request deletion of your account, you can contact us at contact@digitalbandidos.com. For accounts created through platforms such as Steam or Google, deletion requests must be made directly through those platforms, and their procedures apply.

Once data is no longer needed for legal or operational purposes, we will securely delete, archive, or anonymize it in accordance with applicable laws and best practices.

We will also take all necessary steps to mitigate the impact and implement additional security measures to prevent future incidents.

Our Services may contain links to third-party websites or services. Digital Bandidos is not responsible for the security or privacy practices of these external sites. We encourage you to review the privacy policies and terms of use of any third-party services before accessing or using them

Include your name, the email address associated with your account, and a brief description of the right you wish to invoke. We will respond within 30 days in accordance with applicable privacy laws, including GDPR, CCPA, VCDPA, and other relevant regulations.

A. Managing Your Data With Us

1. Accounts

If you sign up for our Services and create an account, we provide you with options to customize your privacy preferences within your account settings. By adjusting these settings, you can actively manage the level of access and visibility of your personal data, ensuring that your privacy aligns with your individual preferences.

2. Communications

If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested.

We may also send you non-promotional communications regarding us and our Services regarding our Services or updates to our Terms or this Privacy Policy.

3. Advertising 

If you prefer not to receive marketing messages or sponsored content, please contact us at contact@digitalbandidos.com and we will ensure your preferences are updated accordingly.

If you are a resident of California, you have the right under the CCPA to opt out of the sale or sharing of your personal data. To opt out of the sale or sharing of your data, please contact us at contact@digitalbandidos.com, and include “Do Not Sell or Share My Personal Data” in the subject line. We will not discriminate against you for exercising any of these rights.

Many of our mobile applications use SDKs and APIs to enable additional functions, including in-app purchases, ads, and analytics. Certain permissions—such as access to personal data, location services, and usage analytics—can be managed in your device’s privacy and application settings. However, some features, like in-app purchases, operate independently of these privacy settings.
